Office of the Prosecutor’s Mission Statement

The Prosecutor is responsible for prosecuting violations of criminal and conservation laws. The Prosecutor also reviews requests for Tribal search warrants, warrants for arrest, and reviews all police reports presented by the Public Safety Department.

Tribal law requires the Prosecutor intervene in all state court matters involving a child who is a member or is eligible for membership in the Tribe. In juvenile delinquency matters, the Prosecutor will monitor state court proceedings and, in some cases, facilitate a transfer of the matter to Tribal Court. In cases of neglect or abuse, the Prosecutor serves as the Tribe’s presenting officer and will ensure that all of the special protections for tribal children and the Tribe are applied. This includes protections and rights under the Indian Child Welfare Act of 1978 (ICWA), including the associated federal regulations and guidelines, as well as protections under the Michigan Indian Family Preservation Act.

If your child is a Tribal Member or eligible for enrollment, and Child Protective Services (CPS) has removed your child or filed a petition to remove your child from your home, you may have rights under the Indian Child Welfare Act (ICWA). Please call the Office of the Prosecutor or the Family Services Department to learn more about these rights.
